Beta Services Addendum

1. Introduction and Scope
This Beta Services Addendum ("Addendum") supplements and forms part of the Stream View Terms of Service ("Terms"). By participating in the Stream View Beta Program, you agree to be bound by this Addendum in addition to the Terms.
In the event of any conflict between this Addendum and the Terms, this Addendum shall prevail during the Beta Period.
1.1 Definitions
- "Beta Period" means the period during which Stream View is operating in beta, commencing on the Effective Date and ending when Stream View announces general availability or terminates the Beta Program.
- "Beta Services" means the Stream View platform and all features made available during the Beta Period.
- "Beta Tester" means any user who accesses the Beta Services during the Beta Period.
2. Beta Status Acknowledgment
2.1 Pre-Release Software
You acknowledge and agree that:
- The Beta Services are pre-release software that is still under development
- The Beta Services may contain bugs, errors, and other problems that could cause system failures, data loss, or other issues
- Features, functionality, and user interfaces may change significantly without notice
- The Beta Services may not operate as intended or as described in any documentation
- Performance, reliability, and availability may be limited compared to production services
2.2 No Production Use Warranty
THE BETA SERVICES ARE PROVIDED FOR EVALUATION AND TESTING PURPOSES ONLY.
You acknowledge that:
- The Beta Services are not intended for production or commercial use requiring high reliability
- You should not rely solely on the Beta Services for critical streaming operations
- We recommend maintaining backup streaming solutions during the Beta Period
- You assume all risks associated with using pre-release software
3. Service Levels and Availability
3.1 No Uptime Guarantee
During the Beta Period:
- We do not guarantee any specific uptime or availability for the Beta Services
- The Beta Services may experience extended downtime for maintenance, updates, or bug fixes
- We may take the Beta Services offline at any time without prior notice
- Scheduled maintenance windows are not guaranteed, and emergency maintenance may occur at any time
3.2 Performance Expectations
You acknowledge that during the Beta Period:
- Stream quality and stability may vary
- Encoding and streaming performance may be inconsistent
- Platform connections may experience interruptions
- Features may be temporarily unavailable or degraded
3.3 Support Limitations
During the Beta Period:
- Support response times may be longer than production service levels
- Not all issues may be immediately resolvable
- Some bugs or feature requests may be deferred until after beta
- Support is provided on a best-effort basis
4. Features and Changes
4.1 Feature Modifications
We reserve the right during the Beta Period to:
- Add, modify, or remove features without prior notice
- Change pricing, tier structures, or storage limits
- Modify user interfaces and workflows
- Alter API endpoints or integrations
- Enable or disable experimental features
4.2 No Feature Commitment
You acknowledge that:
- Features available during beta may not be available in the production release
- Beta-exclusive features may be discontinued
- Feature availability may vary during the Beta Period
- Documentation may not reflect current functionality
5. Data and Content
5.1 Data Loss Risk
IMPORTANT: During the Beta Period, there is an increased risk of data loss.
You acknowledge and agree that:
- Your User Content may be lost, corrupted, or deleted due to bugs or system failures
- We strongly recommend maintaining local backups of all content you upload
- Database migrations or system updates may affect stored data
- We are not liable for any data loss during the Beta Period
5.2 Backup Recommendations
We strongly recommend that you:
- Maintain local copies of all media files uploaded to the Service
- Export playlist configurations regularly
- Document your stream settings and configurations
- Keep records of platform connection credentials
6. Feedback and Improvements
6.1 Feedback Provision
As a Beta Tester, you may provide feedback including bug reports, feature suggestions, usability observations, and performance reports.
6.2 Feedback License
By providing feedback, you grant Stream View a perpetual, irrevocable, worldwide, royalty-free license to use, modify, and incorporate feedback into the Service without compensation or attribution.
7. Beta Program Participation
7.1 Beta Tester Obligations
As a Beta Tester, you agree to:
- Use the Beta Services in good faith for evaluation purposes
- Report significant bugs or issues you encounter
- Not publicly disparage the Beta Services based on beta-specific limitations
- Maintain confidentiality of any non-public beta features or information
- Comply with all Terms and this Addendum
7.2 Confidentiality
During the Beta Period, you agree to keep confidential any non-public features, roadmaps, or technical information, and treat all beta communications as confidential unless marked otherwise.
8. Termination
8.1 Beta Period Termination
The Beta Period will end when Stream View announces general availability, terminates the Beta Program, or 12 months have elapsed from the Effective Date.
8.2 Individual Participation Termination
Your participation in the Beta Program may be terminated:
- By you: At any time, for any reason
- By Stream View: At any time, for any reason, at our sole and absolute discretion
8.3 Discretionary Removal from Beta Program
Stream View reserves the absolute right to remove any participant from the Beta Program at any time, for any reason or no reason, without prior notice.
Without limiting the generality of the above, we may terminate your beta participation if we determine, in our sole discretion, that:
- You have failed to comply with these terms or the Terms of Service
- You have failed to provide constructive feedback or report issues
- Your usage patterns are inconsistent with beta testing purposes
- You are not a suitable fit for the Beta Program
- Your continued participation is not in the best interests of the Beta Program
- For any other reason we deem appropriate
This right exists regardless of whether you have paid for services, and no refund or compensation is owed for removal from the Beta Program.
8.4 Effect of Termination
Upon termination of your beta participation:
- Your access to the Beta Services will end immediately
- Confidentiality obligations continue for 2 years
- You must cease all use of beta-exclusive features
- We may delete your data in accordance with our data retention policies
9. Disclaimers and Limitations
IN ADDITION TO THE DISCLAIMERS IN THE TERMS:
THE BETA SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITH ALL FAULTS. WE EXPRESSLY DISCLAIM ALL WARRANTIES INCLUDING ANY WARRANTY THAT THE BETA SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
OUR TOTAL LIABILITY FOR CLAIMS ARISING FROM BETA SERVICES SHALL NOT EXCEED AUD $50.
9.1 Assumption of Risk
By participating in the Beta Program, you expressly assume all risks associated with using pre-release software, potential data loss, service interruptions, feature changes, and integration issues.

11. Acknowledgment
BY ACCEPTING THIS BETA SERVICES ADDENDUM, YOU ACKNOWLEDGE THAT:
- You have read and understood this Addendum
- You agree to be bound by this Addendum and the Terms of Service
- You understand the Beta Services are pre-release software with inherent risks
- You accept the enhanced disclaimers and limitations of liability
- You will maintain backups of your content during the Beta Period
- You understand features may change or be removed without notice
- You agree to provide feedback and report issues in good faith
- You will maintain confidentiality of non-public beta information
- Stream View may terminate your beta participation at any time, for any reason, at its sole discretion, without refund or compensation
