1. ACCEPTANCE OF TERMS
These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and Stream View Technologies Pty Ltd ACN 692 948 959 ("Stream View," "we," "us," or "our") governing your access to and use of the Stream View platform, including our website at streamview.co and all related services, features, content, and applications (collectively, the "Service").
BY ACCESSING OR USING THE SERVICE, YOU AGREE TO BE BOUND BY THESE TERMS AND ALL APPLICABLE LAWS AND REGULATIONS. If you do not agree to these Terms, you may not access or use the Service.
We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on our website and updating the "Last Updated" date above. Your continued use of the Service after such changes constitutes acceptance of the modified Terms.
2. DESCRIPTION OF SERVICE
Stream View is a Software-as-a-Service (SaaS) platform that enables content creators to stream video and audio content simultaneously to multiple third-party streaming platforms, including but not limited to YouTube, Twitch, Facebook, and Kick (collectively, "Third-Party Platforms").
The Service provides:
- Multi-platform simultaneous streaming capabilities
- Hardware-accelerated video encoding
- Playlist management and scheduling features
- Logo overlay and branding customization
- 24/7 streaming automation
- Stream analytics and monitoring tools
3. ELIGIBILITY AND ACCOUNT REGISTRATION
3.1 Age Requirement
You must be at least 18 years old to use the Service. By using the Service, you represent and warrant that you are at least 18 years of age.
3.2 Account Creation
To access certain features of the Service, you must create an account. You agree to:
- Provide accurate, current, and complete information during registration
- Maintain and promptly update your account information
- Maintain the security and confidentiality of your account credentials
- Notify us immediately of any unauthorized access to your account
- Accept responsibility for all activities that occur under your account
3.3 Account Suspension and Termination
We reserve the right to suspend or terminate your account at any time, with or without notice, for any reason, including but not limited to:
- Violation of these Terms
- Violation of Third-Party Platform terms
- Copyright infringement or intellectual property violations
- Fraudulent, abusive, or illegal activity
- Failure to pay applicable fees
- Extended periods of inactivity
4. SUBSCRIPTION PLANS AND FEES
4.1 Subscription Tiers
Stream View offers multiple subscription tiers with varying features and limitations:
- Starter Tier: Entry-level features for individual creators (100GB storage, 1 simultaneous stream)
- Professional Tier: Advanced features for professional content creators (300GB storage, 3 simultaneous streams)
- Studio Tier: Full-featured service for established creators and businesses (500GB storage, 5 simultaneous streams)
Specific features, limitations, and pricing for each tier are detailed on our pricing page and may be updated from time to time.
4.2 Billing and Payment
- All fees are stated in United States Dollars (USD) unless otherwise specified
- Subscriptions are billed in advance on a monthly or annual basis
- Your subscription will automatically renew at the end of each billing period at the then-current rate unless you cancel before the renewal date. You may cancel at any time through your account settings or by contacting support@streamview.co
- Payment is due immediately upon subscription or renewal
- All fees are non-refundable except as expressly stated in these Terms or required by law
- We reserve the right to change our fees with 30 days' advance notice
- Failure to pay fees may result in immediate suspension or termination of your account
4.3 Free Trials
We may offer free trial periods for certain subscription tiers. Free trials:
- Are available only to new users (one per person/entity)
- Automatically convert to paid subscriptions unless cancelled before the trial ends
- May have limited features compared to paid subscriptions
- Are subject to these Terms (including Section 8: Acceptable Use Policy)
4.4 Refunds
We do not provide refunds for unused portions of subscription periods except:
- If we terminate your account for reasons other than breach of these Terms
- As required by applicable consumer protection laws
- At our sole discretion on a case-by-case basis
4.5 EU/UK Right of Withdrawal
EU and UK Users: Under the EU Consumer Rights Directive (2011/83/EU) and UK Consumer Contracts Regulations 2013, you have the right to withdraw from your subscription within 14 days of purchase ("cooling-off period") and receive a full refund, without giving any reason.
To exercise this right, you must notify us at support@streamview.co of your decision to withdraw before the 14-day period expires.
Waiver for Immediate Access: If you wish to begin using the Service immediately during the cooling-off period, you may be asked to provide explicit consent to waive your withdrawal right. By providing such consent and accessing the Service, you acknowledge that:
- You expressly requested that we begin providing the Service immediately
- You lose your right of withdrawal once the digital content has been accessed
- This waiver applies only to the extent permitted by applicable law
If you have not waived your withdrawal right and have not accessed the Service, you are entitled to a full refund within the 14-day period.
5. USER CONTENT AND RESPONSIBILITIES
5.1 User Content Definition
"User Content" means any and all content you upload, stream, transmit, or otherwise make available through the Service, including but not limited to:
- Video files and livestream content
- Audio files and music
- Images, logos, and graphics
- Metadata, titles, and descriptions
- Any other materials you provide
5.2 User Content Ownership
You retain all ownership rights to your User Content. By using the Service, you grant Stream View a limited, non-exclusive, royalty-free, worldwide license to:
- Store, process, and transmit your User Content as necessary to provide the Service
- Create backup copies for reliability and disaster recovery
- Analyze aggregated, anonymized usage data for service improvement
- Display your content on Third-Party Platforms as directed by you
This license terminates when you delete your User Content or close your account, except for archival copies retained for legal compliance purposes.
5.3 User Content Warranties and Representations
By uploading or streaming User Content through the Service, you represent and warrant that:
a) Content Ownership and Rights:
- You own all rights to the User Content or have obtained all necessary permissions, licenses, and clearances
- Your User Content does not infringe, misappropriate, or violate any intellectual property rights of any third party
- You have secured all necessary music licensing, including mechanical, synchronization, public performance, and master recording rights for any music included in your streams
- You have obtained all necessary rights from any individuals appearing in your content, including image rights and privacy releases
b) Platform Compliance:
- Your User Content and use of the Service comply with all applicable terms of service, community guidelines, and policies of all Third-Party Platforms to which you stream
- You will not stream content that violates YouTube Terms of Service, YouTube Community Guidelines, Twitch Terms of Service, Twitch Community Guidelines, Facebook Terms of Service, Facebook Community Standards, Kick Terms of Service, or any other applicable Third-Party Platform policies
- You understand that Third-Party Platforms may independently enforce their terms and take action against your accounts, and that Stream View is not responsible for such enforcement
c) Legal Compliance:
- Your User Content complies with all applicable laws, regulations, and industry standards
- Your User Content does not violate any person's rights of publicity, privacy, or other personal rights
- Your User Content is not defamatory, libelous, obscene, pornographic, or otherwise objectionable
- Your User Content does not contain malware, viruses, or other harmful code
d) Content Restrictions:
- Your User Content does not include copyrighted material unless you own the copyright or have permission to use it
- You will not stream content containing unauthorized copyrighted music, video clips, sports broadcasts, or other protected materials
- You will not use the Service to infringe on any patents, trademarks, trade secrets, copyrights, or other intellectual property rights
5.4 Prohibited Content
You agree not to upload, stream, or transmit User Content that:
- Infringes intellectual property rights of any third party
- Contains unlicensed copyrighted music or video
- Violates Third-Party Platform terms or policies
- Is illegal, harmful, threatening, abusive, harassing, defamatory, or hateful
- Contains child sexual abuse material or exploits minors
- Promotes violence, terrorism, or illegal activities
- Contains graphic violence or shocking content
- Is sexually explicit or pornographic
- Violates privacy or publicity rights
- Contains personal information of others without consent
- Is spam, malware, or phishing content
- Impersonates any person or entity
5.5 Content Monitoring
Stream View has no obligation to monitor User Content but reserves the right to:
- Review User Content for compliance with these Terms
- Remove or disable access to User Content that violates these Terms
- Report illegal content to law enforcement authorities
- Cooperate with legal investigations and subpoenas
We do not pre-screen content and are not responsible for User Content uploaded by users.
6. COPYRIGHT POLICY AND DMCA COMPLIANCE
6.1 Repeat Infringer Policy
Stream View respects intellectual property rights and expects users to do the same. We maintain a policy for terminating accounts of users who repeatedly infringe copyrights or other intellectual property rights.
Three-Strike Policy:
- First Strike: Warning and content removal
- Second Strike: Temporary suspension (7-30 days)
- Third Strike: Permanent account termination
Strikes are assessed on a rolling 12-month basis. Users who accumulate three copyright infringement notices within any 12-month period will have their accounts permanently terminated without refund.
6.2 DMCA Notice and Takedown Procedure
If you believe that content streamed through the Service infringes your copyright, you may submit a notice of alleged infringement under the U.S. Digital Millennium Copyright Act (DMCA) to our designated Copyright Agent.
DMCA Notices must include:
- A physical or electronic signature of the copyright owner or authorized representative
- Identification of the copyrighted work claimed to have been infringed
- Identification of the allegedly infringing material with sufficient detail for us to locate it
- Your contact information (address, telephone number, email)
- A statement that you have a good faith belief that the use is not authorized
- A statement under penalty of perjury that the information is accurate and you are authorized to act on behalf of the copyright owner
- The statement: "I swear, under penalty of perjury, that the information in this notification is accurate and that I am the copyright owner, or am authorized to act on behalf of the owner, of an exclusive right that is allegedly infringed."

6.3 Counter-Notification Procedure
If you believe your content was removed due to a mistake or misidentification, you may file a counter-notification with our Copyright Agent.
Counter-Notifications must include:
- Your physical or electronic signature
- Identification of the material that was removed and its location before removal
- A statement under penalty of perjury that you have a good faith belief the material was removed by mistake or misidentification
- Your name, address, telephone number, and email address
- A statement consenting to jurisdiction of the Federal District Court in the district where you reside (or the Federal District Court for the Eastern District of New South Wales, Australia, if outside the U.S.)
- A statement that you will accept service of process from the complainant
Upon receiving a valid counter-notification, we will forward it to the original complainant. If the complainant does not file a court action within 10-14 business days, we may restore the removed content.
6.4 False Claims
Submitting a false or fraudulent DMCA notice or counter-notice may result in:
- Liability for damages, including costs and attorney's fees
- Account termination
- Legal action under federal law (18 U.S.C. Section 1621)
6.5 International Copyright Considerations
While we comply with U.S. DMCA procedures, we also respect copyright laws in other jurisdictions, including:
- Australian Copyright Act 1968
- European Union Copyright Directive
- Other applicable international copyright treaties
Copyright owners in any jurisdiction may submit takedown notices following the procedures outlined above.
7. THIRD-PARTY PLATFORM INTEGRATION
7.1 Third-Party Terms Incorporation
When you use the Service to stream to Third-Party Platforms, you acknowledge and agree that:
- You are bound by all current and future terms of service, community guidelines, developer policies, and other rules of each Third-Party Platform
- You are solely responsible for compliance with all Third-Party Platform terms
- Stream View makes no representations or warranties regarding Third-Party Platform acceptance of your streams
- Third-Party Platforms may independently suspend, terminate, or restrict your accounts for violations of their terms
- Stream View is not responsible for any actions taken by Third-Party Platforms, including content removal, account suspension, or termination
- You must maintain valid accounts in good standing with all Third-Party Platforms you wish to use
7.2 Platform-Specific Requirements
YouTube:
- You must comply with YouTube Terms of Service and YouTube Community Guidelines
- You must maintain an eligible YouTube channel in good standing
- You are responsible for obtaining required licenses for music through YouTube Content ID or direct licensing
- Stream View is not responsible for Content ID claims, copyright strikes, or channel terminations
Twitch:
- You must comply with Twitch Terms of Service and Twitch Community Guidelines
- You must have appropriate music licensing (e.g., Twitch Soundtrack, direct licensing)
- You are responsible for compliance with Twitch's DMCA policies
- Stream View is not responsible for DMCA strikes or account suspensions
Facebook:
- You must comply with Facebook Terms of Service and Facebook Community Standards
- You must maintain a Facebook Page or profile authorized for live streaming in good standing
- You are responsible for music licensing through Facebook's Rights Manager or direct licensing
- Stream View is not responsible for content takedowns or account restrictions
Kick:
- You must comply with Kick Terms of Service and Kick Community Guidelines
- You must maintain a Kick creator account in good standing
- Stream View is not responsible for any actions taken by Kick
7.3 API Access and Changes
Third-Party Platforms may modify their APIs, terms, or policies at any time. Stream View will make reasonable efforts to maintain compatibility, but:
- We do not guarantee uninterrupted access to any Third-Party Platform
- We are not liable for disruptions caused by Third-Party Platform changes
- We may discontinue support for Third-Party Platforms that materially change their terms or APIs
- You acknowledge that streaming capabilities may be affected by Third-Party Platform decisions
7.4 Authentication and Credentials
You authorize Stream View to:
- Access your Third-Party Platform accounts using authentication tokens you provide
- Stream content to your connected Third-Party Platform accounts
- Retrieve analytics and metadata from Third-Party Platforms
- Store encrypted authentication credentials securely
You are responsible for:
- Maintaining valid authentication with Third-Party Platforms
- Revoking Stream View's access if you wish to disconnect platforms
- Understanding that disconnecting OAuth authentication will remove automatic credential management, though you may still stream via manual RTMP configuration
7.5 Platform Enforcement Flow-Through
If a Third-Party Platform takes enforcement action against your account (e.g., copyright strike, community guidelines violation, suspension), Stream View reserves the right to:
- Temporarily suspend your ability to stream to that platform
- Investigate the circumstances leading to the enforcement action
- Terminate your Stream View account if the violation also breaches these Terms
- Take no action if the violation is solely a Third-Party Platform matter
We have no obligation to contest or appeal Third-Party Platform enforcement actions on your behalf.
8. ACCEPTABLE USE POLICY
This Acceptable Use Policy ("AUP") is incorporated into and forms part of these Terms of Service. By using the Service, you agree to comply with this AUP in addition to all other provisions of these Terms.
This section sets forth the acceptable use requirements for the Service. Violation of this section may result in content removal, account suspension, account termination, legal action, or reporting to law enforcement. Serious violations may result in immediate action without prior warning.
8.1 Prohibited Content
In addition to the prohibited content listed in Section 5.4, you may not upload, stream, or transmit content that:
a) Is Illegal or Harmful:
- Child sexual abuse material (CSAM), child exploitation, grooming, or endangerment content
- Solicitation or facilitation of child sexual abuse material
- Sexualization of minors or predatory behavior targeting minors
- Dangerous challenges or trends designed to harm minors
- Content promoting terrorism or violent extremism
- Instructions for making weapons or explosives
- Trafficking, selling, or facilitating sale of weapons
- Instructions for modifying weapons to be more dangerous or creating dangerous devices
- Sale of illegal drugs or controlled substances
- Promotion of prescription medication misuse or self-medication without medical supervision
- Sale or distribution of counterfeit pharmaceuticals
- Promotion of unproven medical treatments as cures or remedies
- Content violating financial crime laws or sanctions
b) Is Violent or Graphic:
- Extreme graphic violence or gore
- Content glorifying violence or real-world death
- Animal cruelty or abuse
- Self-harm or suicide content that promotes such behavior
c) Is Hateful or Discriminatory:
- Content promoting hatred based on race, ethnicity, religion, disability, gender, or sexual orientation
- Hate speech, slurs, or ethnic supremacist content
- Content denying well-documented violent events
d) Harasses or Threatens Others:
- Bullying, harassment, stalking, or doxxing
- Threats of violence, blackmail, or extortion
- Coordinated harassment campaigns
e) Is Deceptive or Contains Malicious Code:
- Scams, phishing, impersonation, or fraudulent schemes
- Manipulated media (deepfakes) used to deceive or mislead
- AI-generated synthetic intimate content (sexual deepfakes) depicting real people without consent
- Deepfakes of public figures used to make false statements or spread misinformation
- AI-generated content used to impersonate real individuals without disclosure
- Significant undisclosed use of synthetic media that could mislead audiences
- Malware, viruses, ransomware, or exploit code
f) Is Sexually Explicit or Non-Consensual:
- Pornography or sexually explicit content
- Non-consensual sexual content or intimate images shared without consent
- Revenge porn or intimate imagery used to harass or exploit
- Sexual content involving minors (in addition to CSAM prohibitions above)
- Sexual services, prostitution, or escort advertising
g) Violates Privacy Rights:
- Personal information of others without their consent
- Private photos, videos, or recordings without consent
- Medical, financial, or identity information of others
- Government-issued identification documents
- Information that could facilitate identity theft or fraud
- Home addresses, phone numbers, or location data without consent
8.2 Prohibited Activities
You may not use the Service to:
a) Abuse the Service:
- Create multiple accounts to evade restrictions
- Share accounts or sell/transfer your account
- Use automated bots or scripts except as authorized
- Reverse engineer, probe, or test vulnerabilities
- Circumvent security measures or access controls
- Use the Service beyond your subscription limits
- Stream blank screens or "sleep streams" to inflate metrics
b) Spam or Mislead:
- Send unsolicited bulk messages or engage in SEO spam
- Post misleading metadata, titles, or descriptions
- Artificially inflate view counts or engagement
- Manipulate platform algorithms or create fake engagement
c) Interfere with Operations:
- Disrupt the Service or place excessive load on infrastructure
- Launch denial-of-service attacks
- Interfere with other users' access
- Bypass rate limiting or throttling
d) Evade Enforcement:
- Create new accounts after termination
- Use VPNs or proxies to evade geographic restrictions
- Circumvent content filtering or monitoring systems
- Interfere with DMCA or copyright enforcement mechanisms
- Remove or disable copyright management information
e) Circumvent Third-Party Platform Restrictions:
- Use banned or suspended platform accounts to stream
- Create alternate accounts to evade platform enforcement
- Assist others in circumventing platform bans or restrictions
- Stream content previously removed by platforms for policy violations
f) Misuse Intellectual Property:
- Claim ownership of content you did not create
- Remove, alter, or obscure copyright notices or watermarks
- Use trademarks, logos, or branding without authorization
- Impersonate brands, businesses, or other creators
- Create confusion about content ownership or source
- File false copyright claims against others
g) Exploit Vulnerabilities or Harvest Data:
- Exploit security vulnerabilities in the Service or related systems
- Access data or systems you are not authorized to access
- Scrape, harvest, or collect user data without authorization
- Use the Service to attack, probe, or exploit third-party systems
- Assist others in gaining unauthorized access to any systems
- Intercept or monitor data transmissions without authorization
8.3 Music Licensing Requirements
You are responsible for obtaining all necessary music licenses before streaming:
Required Licenses:
- Mechanical licenses for reproductions
- Synchronization licenses for video use
- Public performance licenses (ASCAP, BMI, SESAC, etc.)
- Master recording licenses from copyright holders
Acceptable Music Sources:
- Royalty-free music libraries
- Creative Commons licensed music (with proper attribution)
- Music you own or created
- Platform-approved music (YouTube Audio Library, Twitch Soundtrack, etc.)
- Properly licensed music services or direct licenses from rights holders
Prohibited Music Sources:
- Commercial music without licenses
- Copyrighted music from streaming services (Spotify, Apple Music, etc.)
- Background music from movies, TV shows, or video games
- Radio broadcasts or podcasts containing copyrighted music
- DJ mixes or remixes without proper clearances
8.4 Enforcement Actions
Depending on the severity and frequency of violations, we may take the following actions:
Minor Violations: Warning notice, temporary content removal, educational information
Repeat Violations: Temporary account suspension (7-30 days), loss of features, permanent content removal
Serious Violations: Immediate account termination, permanent ban, reporting to law enforcement, legal action
8.5 Appeals Process
If you believe enforcement action was taken in error:
- Submit Appeal: Email support@streamview.co with account details, explanation, and supporting evidence
- Review Timeline: Initial response within 3-5 business days; full review within 14 days
- Outcomes: Action upheld, action overturned (account/content restored), or modified action (reduced penalty)
- Final Decisions: Appeal decisions are final except as required by law
8.6 Reporting Violations
To report content or behavior violating this policy:
- General Reports: Email support@streamview.co with URL/account identifier, description, and screenshots
- Copyright Violations: Submit DMCA notice per Section 6
- Child Safety Concerns: Email support@streamview.co marked "URGENT: Child Safety"
- Emergency or Immediate Danger: Contact local law enforcement immediately, then notify us
Submitting false or fraudulent reports may result in account termination and legal liability.
Child Sexual Abuse Material (CSAM) and Exploitation Reporting:
- We report suspected CSAM and child exploitation to the National Center for Missing & Exploited Children (NCMEC) and applicable law enforcement within 24 hours of discovery or report
- Reports trigger immediate content removal and preservation of evidence for law enforcement
- We comply with all Australian Online Safety Act 2021 reporting obligations
- For users in the European Union: Data breaches involving minors' personal data are reported to competent supervisory authorities within 72 hours as required by GDPR Articles 33-34
eSafety Commissioner Compliance (Australia):
- Stream View acknowledges the authority of the Australian eSafety Commissioner under the Online Safety Act 2021
- Content classified as notifiable content (cyberbullying, image-based abuse, terrorist content, etc.) will be assessed and removed within 48 hours of notification where appropriate
- Users may lodge complaints directly with the eSafety Commissioner at www.esafety.gov.au
- Stream View cooperates fully with eSafety Commissioner investigations and removal notices as required by law
- Compliance with eSafety Commissioner notices is mandatory and non-negotiable
8.7 Geographic Restrictions
Streaming may be restricted from certain jurisdictions due to legal restrictions, sanctions, or platform policies. Using VPNs or proxies to circumvent geographic restrictions is prohibited and may result in account termination.
8.8 Account Security
You are responsible for maintaining account security by using strong, unique passwords, enabling two-factor authentication when available, keeping credentials confidential, not sharing your account, and reporting unauthorized access immediately.
8.9 Commercial Use
Permitted: Monetizing through platform programs, displaying platform-approved ads, accepting compliant sponsorships, selling your own products/services, using affiliate links where platform-permitted.
Prohibited: Pyramid schemes or MLM, fraudulent advertising, misrepresenting products, violating advertising regulations, promoting illegal products, deceptive marketing practices.
8.10 Third-Party Content and Links
If you include links, references, or integrations with third-party content or services in your streams:
Your Responsibilities:
- You are responsible for all content you link to or reference
- Ensure all linked content complies with this Acceptable Use Policy
- Do not link to sites hosting prohibited content
- Do not link to copyright-infringing content or piracy sites
- Do not link to malware, phishing, or scam sites
Third-Party Integrations:
- You must comply with the terms of service of any third-party tools you integrate
- Ensure third-party integrations (chatbots, overlays, etc.) do not violate this AUP
- You are responsible for actions performed by third-party tools on your behalf
- We may disable integrations that violate our policies
8.11 Compliance with Applicable Laws
You must comply with all applicable laws and regulations when using the Service, including but not limited to:

- Australian Copyright Act 1968
- U.S. Digital Millennium Copyright Act (DMCA)
- International copyright treaties and conventions
- Trademark and patent laws in applicable jurisdictions
Privacy and Data Protection:
- Australian Privacy Act 1988
- General Data Protection Regulation (GDPR) for EU audiences
- California Consumer Privacy Act (CCPA) for California audiences
- Other applicable data protection laws
Content Regulation (Australia):
- Australian Broadcasting Services Act 1992
- Classification (Publications, Films and Computer Games) Act 1995
- Telecommunications Act 1997
- Criminal Code Act 1995 (cybercrime provisions)
- Online Safety Act 2021
Export Control and Sanctions:
- Australian Defence Trade Controls Act 2012
- Applicable export control laws
- International sanctions regimes
- Restrictions on streaming to sanctioned countries or persons
Consumer Protection:
- Australian Consumer Law (Competition and Consumer Act 2010)
- Advertising standards and regulations
- Truth in advertising requirements
8.12 Prohibited Account Activities
In addition to the account security requirements in Section 8.8, the following account activities are prohibited:
- Sharing your account credentials with any other person
- Selling, transferring, or renting your account to others
- Using account credentials that belong to another person
- Creating accounts using false, misleading, or fraudulent information
- Creating accounts on behalf of other persons or entities without authorization
- Maintaining multiple accounts to circumvent restrictions, bans, or enforcement actions
- Using automated tools or scripts to create accounts
- Purchasing or acquiring accounts from third parties
- Allowing unauthorized persons to access or use your account

9. INDEMNIFICATION
9.1 User Indemnification Obligations
You agree to indemnify, defend, and hold harmless Stream View Technologies Pty Ltd, its officers, directors, employees, agents, affiliates, subsidiaries, licensors, and partners (collectively, "Stream View Parties") from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees and legal costs) arising from or relating to:
a) Your User Content:
- Any claim that your User Content infringes, misappropriates, or violates any intellectual property rights of any third party
- Any claim that your User Content violates any person's rights of privacy, publicity, or other personal rights
- Any claim that your User Content is defamatory, libelous, obscene, or otherwise unlawful
b) Your Use of the Service:
- Your access to or use of the Service
- Your violation of these Terms
- Your violation of any Third-Party Platform terms, policies, or guidelines
- Your violation of any applicable laws or regulations
c) Your Accounts and Actions:
- Unauthorized use of your account by third parties due to your failure to maintain account security
- Your fraudulent, negligent, or willful misconduct
- Any actions taken through your account, whether authorized by you or not
d) Third-Party Claims:
- Claims by Third-Party Platforms arising from your use of their services through Stream View
- Claims by content creators, rights holders, or other parties regarding your User Content
- Claims by viewers or audience members regarding your streams
9.2 Indemnification Procedures
Stream View will:
- Provide you with prompt written notice of any claim subject to indemnification
- Allow you to control the defense and settlement of the claim (subject to our approval, which will not be unreasonably withheld)
- Cooperate with you in the defense at your expense
You may not settle any claim without Stream View's prior written consent if the settlement:
- Admits fault or liability on behalf of Stream View
- Imposes any obligations or restrictions on Stream View
- Does not include a full release of Stream View from all liability
9.3 Survival
Your indemnification obligations survive termination of these Terms and your use of the Service.
9.4 Consumer Protection Limitations
Consumer Users: The indemnification obligations in this Section 9 shall not apply to the extent they would be deemed unfair or unenforceable under applicable consumer protection laws, including:
- The EU Unfair Contract Terms Directive (93/13/EEC)
- The UK Consumer Rights Act 2015
- The Australian Consumer Law (Schedule 2, Competition and Consumer Act 2010)
- Any other jurisdiction where such indemnification obligations are prohibited or limited by mandatory consumer protection law
Where such laws apply, your liability is limited to the extent permitted by those laws, and you will not be required to indemnify Stream View for claims arising from our own negligence, breach of contract, or violation of applicable law.
10. DISCLAIMER OF WARRANTIES
10.1 "AS IS" and "AS AVAILABLE" Service
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, STREAM VIEW DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:
- IMPLIED WARRANTIES OF MERCHANTABILITY
- IMPLIED WARRANTIES OF FITNESS FOR A PARTICULAR PURPOSE
- IMPLIED WARRANTIES OF NON-INFRINGEMENT
- WARRANTIES ARISING FROM COURSE OF DEALING OR COURSE OF PERFORMANCE
- WARRANTIES THAT THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE
- WARRANTIES THAT DEFECTS WILL BE CORRECTED
- WARRANTIES REGARDING THE QUALITY, ACCURACY, OR RELIABILITY OF THE SERVICE
10.2 Third-Party Platform Disclaimer
STREAM VIEW MAKES NO WARRANTIES REGARDING:
- The availability, performance, or reliability of Third-Party Platforms
- The acceptance of your streams by Third-Party Platforms
- The compliance of Third-Party Platforms with their own terms or policies
- The actions or decisions of Third-Party Platforms
- The impact of Third-Party Platform changes on your use of the Service
10.3 Content Disclaimer
STREAM VIEW DOES NOT:
- Pre-screen, approve, or endorse User Content
- Guarantee that User Content complies with copyright laws or Third-Party Platform terms
- Warrant that your use of the Service will not result in copyright claims or enforcement actions
- Assume responsibility for the accuracy, legality, or appropriateness of User Content
10.4 Technical Disclaimer
STREAM VIEW DOES NOT WARRANT THAT:
- The Service will meet your specific requirements or expectations
- Your streams will maintain consistent quality or bitrate
- Hardware acceleration will be available on all systems
- The Service will be compatible with all third-party software or hardware
- Data transmission will be completely secure or free from interception
10.5 Advice Disclaimer
STREAM VIEW DOES NOT PROVIDE:
- Legal advice regarding copyright, licensing, or intellectual property
- Technical support for Third-Party Platforms
- Guidance on music licensing or rights clearance
- Advice regarding tax, accounting, or business matters
You should consult appropriate professionals for advice on these matters.
11. LIMITATION OF LIABILITY
11.1 Liability Cap
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL STREAM VIEW'S TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE EXCEED THE GREATER OF:
- The total amount of fees you paid to Stream View in the twelve (12) months immediately preceding the claim; OR
- One hundred Australian dollars (AUD $100)
11.2 Exclusion of Consequential Damages
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, STREAM VIEW SHALL NOT BE LIABLE FOR ANY:
- INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
- LOST PROFITS, LOST REVENUE, OR LOST BUSINESS OPPORTUNITIES
- LOSS OF DATA OR LOSS OF GOODWILL
- COST OF SUBSTITUTE GOODS OR SERVICES
- LOSS OF VIEWERS, SUBSCRIBERS, OR AUDIENCE
- DAMAGE TO REPUTATION OR BRAND
- BUSINESS INTERRUPTION
- FAILURE TO REALIZE EXPECTED SAVINGS
- THIRD-PARTY PLATFORM ENFORCEMENT ACTIONS
This limitation applies regardless of:
- The legal theory of liability (contract, tort, strict liability, or otherwise)
- Whether Stream View was advised of the possibility of such damages
- Whether any remedy fails of its essential purpose
11.3 Third-Party Platform Actions
STREAM VIEW IS NOT LIABLE FOR:
- Decisions, actions, or policies of Third-Party Platforms
- Suspension, termination, or restrictions imposed by Third-Party Platforms
- Content removals or copyright strikes on Third-Party Platforms
- Changes to Third-Party Platform APIs, terms, or features
- Loss of Third-Party Platform accounts or privileges
- Enforcement actions taken by Third-Party Platforms
11.4 Copyright and IP Claims
STREAM VIEW IS NOT LIABLE FOR:
- Copyright infringement claims arising from your User Content
- Intellectual property disputes regarding your streams
- Music licensing violations or unlicensed content in your streams
- DMCA strikes, takedown notices, or legal actions by rights holders
- Repeat infringer status or account terminations due to copyright violations
11.5 Technical Issues
STREAM VIEW IS NOT LIABLE FOR:
- Service interruptions, outages, or downtime
- Loss or corruption of User Content
- Failure of hardware acceleration or encoding
- Network connectivity issues
- Compatibility issues with your hardware or software
- Bugs, errors, or defects in the Service
11.6 Security Breaches
STREAM VIEW IS NOT LIABLE FOR:
- Unauthorized access to your account due to weak passwords or compromised credentials
- Hacking, phishing, or social engineering attacks
- Data breaches affecting Third-Party Platforms
- Malware, viruses, or other harmful code introduced through third-party services
11.7 Australian Consumer Law and Consumer Guarantees
Nothing in these Terms excludes, restricts, or modifies any consumer rights under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010) or other mandatory consumer protection laws that cannot be excluded by agreement.
For Australian Consumers:
If you are a consumer acquiring the Service for personal, domestic, or household use (not for business purposes), your statutory rights under the Australian Consumer Law are not excluded or limited by these Terms. Notwithstanding any limitation of liability in Sections 11.1 through 11.6, you have the following non-excludable rights:
- Refund or Repair: Your right to a refund, repair, or replacement if the Service fails to provide essential functionality due to our error (e.g., inability to stream to connected platforms)
- Consumer Guarantees: Your rights under consumer guarantees in sections 60-63 of the Australian Consumer Law, including that services will be rendered with due care and skill, fit for purpose, and provided within a reasonable time
- Right to Reject: Your right to reject the Service within a reasonable time if it is not of acceptable quality or fit for the purpose for which it was acquired
- Damages for Loss: Your right to claim compensation for reasonably foreseeable loss or damage caused by our failure to exercise due care and skill
Consumer Guarantee Remedies:
Where the Service is found to breach consumer guarantees, our liability is NOT limited to the amounts specified in Section 11.1. Instead, you may be entitled to:
- A full or pro-rated refund of fees paid
- The cost of having the Service remedied to make it fit for purpose
- Compensation for reasonably foreseeable loss caused by the breach
- Any other remedy available under the Australian Consumer Law
This section applies only to consumers as defined by the Australian Consumer Law and does not apply to business users, corporate accounts, or services acquired for commercial purposes.
12. TERMINATION
12.1 Termination by You
You may terminate your account at any time by:
- Accessing your account settings and selecting the termination option
- Sending written notice to support@streamview.co
- Ceasing to pay subscription fees (results in automatic termination after grace period)
Upon termination by you:
- Your subscription will be cancelled effective at the end of your current billing period
- You will not receive refunds for unused time in your billing period
- Your access to the Service will continue until the end of your paid period
- Your User Content and account data will be deleted according to our data retention policy
12.2 Termination by Stream View
We may suspend or terminate your account immediately, with or without notice, for any reason, including:
- Violation of these Terms (including the Acceptable Use Policy in Section 8)
- Violation of Third-Party Platform terms or policies
- Copyright infringement or repeat infringer status
- Fraudulent, abusive, or illegal activity
- Non-payment of fees
- Extended periods of inactivity (more than 12 months)
- Technical or security concerns
- Discontinuation of the Service or specific features
Upon termination by Stream View for cause:
- All licenses granted to you terminate immediately
- You must immediately cease all use of the Service
- You will not receive refunds for unused subscription time
- We may immediately delete your User Content and account data
Upon termination by Stream View without cause:
- You may receive a pro-rated refund for unused subscription time at our discretion
- We will provide reasonable notice (typically 30 days) unless immediate termination is required for legal or security reasons
12.3 Effect of Termination
Upon termination for any reason:
- All licenses granted under these Terms immediately terminate
- You must immediately cease accessing or using the Service
- You must delete any downloaded or cached content from the Service
- We may delete your User Content, account data, and all associated information
- Provisions of these Terms that by their nature should survive termination will survive, including: ownership, indemnification, disclaimer of warranties, limitation of liability, and dispute resolution
12.4 Data Retention After Termination
After account termination:
- User Content may be retained for up to 30 days for account recovery purposes
- After 30 days, User Content will be permanently deleted and cannot be recovered
- We may retain certain account information for legal compliance, fraud prevention, and accounting purposes
- Anonymized usage data may be retained indefinitely for analytics and service improvement
13. DISPUTE RESOLUTION AND GOVERNING LAW
13.1 Governing Law
These Terms and your use of the Service are governed by and construed in accordance with the laws of New South Wales, Australia, without regard to conflict of law principles.
You agree that the United Nations Convention on Contracts for the International Sale of Goods does not apply to these Terms.
13.2 Jurisdiction and Venue
Subject to the arbitration provisions below, you agree that any legal action or proceeding arising out of or related to these Terms or the Service shall be brought exclusively in the courts of New South Wales, Australia, and you hereby irrevocably submit to the personal jurisdiction and venue of such courts.
13.3 Informal Dispute Resolution
Before initiating any formal legal proceedings, you agree to first contact us at support@streamview.co to attempt to resolve the dispute informally. We will work in good faith to resolve disputes through negotiation.
13.4 Arbitration Agreement (International Users)
For users outside Australia, any dispute, claim, or controversy arising out of or relating to these Terms or the Service that cannot be resolved through informal negotiation may be resolved by binding arbitration in accordance with the Commercial Arbitration Rules of the Australian Centre for International Commercial Arbitration (ACICA).
Arbitration terms:
- The arbitration shall be conducted in English
- The seat of arbitration shall be Sydney, New South Wales, Australia
- There shall be one arbitrator appointed in accordance with ACICA rules
- The arbitrator's decision shall be final and binding
- Judgment on the arbitration award may be entered in any court having jurisdiction
13.5 Class Action Waiver
TO THE EXTENT PERMITTED BY APPLICABLE LAW, YOU AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION.
EU/UK Users: This class action waiver does not apply to the extent prohibited by mandatory consumer protection laws in your jurisdiction, including the EU Representative Actions Directive (2020/1828) and UK Consumer Rights Act 2015. Nothing in this section prevents you from participating in collective redress actions where permitted by applicable law.
If this class action waiver is found to be unenforceable, then the entirety of this arbitration provision shall be null and void.
13.6 Time Limitation on Claims
You agree that any claim or cause of action arising out of or related to the Service or these Terms must be filed within one (1) year after the claim or cause of action arose, or within the applicable statutory limitation period required by mandatory law in your jurisdiction, whichever is longer. Claims not filed within this period will be permanently barred.
Note: This limitation does not reduce any statutory limitation periods that cannot be shortened by contract under applicable consumer protection laws, including claims under the Australian Consumer Law (6 years) or EU consumer protection regulations.
14. GENERAL PROVISIONS
14.1 Entire Agreement
These Terms, together with our Privacy Policy and any other documents expressly incorporated by reference, constitute the entire agreement between you and Stream View regarding the Service and supersede all prior agreements, understandings, and communications, whether written or oral.
14.2 Modifications to Terms
We reserve the right to modify these Terms at any time. Material changes will be notified by:
- Posting updated Terms on our website with a new "Last Updated" date
- Sending email notification to your registered email address
- Displaying a prominent notice on the Service
Your continued use of the Service after notice of changes constitutes acceptance. If you do not agree to modified Terms, you must stop using the Service and terminate your account.
14.3 Waiver
Our failure to enforce any right or provision of these Terms will not constitute a waiver of that right or provision. Any waiver of any provision of these Terms will be effective only if in writing and signed by an authorized representative of Stream View.
14.4 Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions will continue in full force and effect. The invalid provision will be modified to the minimum extent necessary to make it valid and enforceable.
14.5 Assignment
You may not assign, transfer, or delegate your rights or obligations under these Terms without our prior written consent. We may assign these Terms, in whole or in part, to any person or entity at any time with or without your consent.
14.6 No Third-Party Beneficiaries
These Terms do not and are not intended to confer any rights or remedies upon any person or entity other than you and Stream View.
14.7 Force Majeure
Stream View shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, pandemics, strikes, or shortages of transportation facilities, fuel, energy, labor, or materials.
14.8 Relationship of Parties
These Terms do not create any agency, partnership, joint venture, employment, or franchising relationship between you and Stream View. Neither party has authority to bind the other or incur obligations on the other's behalf.
14.9 Notices
All notices under these Terms must be in writing and will be deemed given:
- When delivered personally
- When sent by confirmed email
- Three business days after being sent by registered or certified mail, return receipt requested
- One business day after being sent by recognized overnight courier service

14.10 Language
These Terms are prepared in English, and the English version shall control in all respects. Any translation is provided for convenience only.
14.11 Headings
Section headings are for convenience only and do not affect the interpretation of these Terms.
14.12 Survival
Provisions that by their nature should survive termination shall survive, including but not limited to: ownership provisions, indemnification, disclaimer of warranties, limitation of liability, dispute resolution, and general provisions.

16. ACKNOWLEDGMENT
BY CLICKING "I AGREE," "I ACCEPT," OR BY ACCESSING OR USING THE SERVICE, YOU ACKNOWLEDGE THAT:
- You have read and understood these Terms of Service
- You agree to be bound by these Terms
- You are at least 18 years of age
- You have the authority to enter into these Terms
- You understand that you are responsible for compliance with all Third-Party Platform terms
- You understand that you are solely responsible for ensuring you have all necessary rights and licenses for your User Content
- You understand the repeat infringer policy and consequences of copyright violations
- You understand the limitation of liability and disclaimer of warranties
- You consent to electronic communications and notices
